Federal Appeals Court Deals Blow to President Obama’s Amnesty

    A federal appeals court upheld an injunction against President Obama’s new deportation in a ruling Tuesday that marks the second major legal setback for an administration that had insisted its actions were legal.

    The U.S. Court of Appeals for the Fifth Circuit ruled in favor of Texas, which had sued to stop the amnesty, on all key points, finding that Mr. Obama’s amnesty likely broke the law governing how big policies are to be written.

    “The public interest favors maintenance of the injunction,” the judges wrote in the majority opinion.
    Mr. Obama had acted in November to try to grant tentative legal status and work permits to as many as 5 million illegal immigrants, saying he was tired of waiting for Congress to act.

    The full amnesty, known as Deferred Action for Parental Accountability, or DAPA, had been scheduled to begin last week, while an earlier part had been slated to accept applications on Feb. 18. But just two days before that, Judge Andrew S. Hanen issued his injunction finding that Mr. Obama had broken the law.

    Administration officials had criticized that ruling, and immigrant-rights advocates had called Judge Hanen an activist bent on punishing immigrants. But Tuesday’s ruling upholds his injunction, giving some vindication to the judge.

    It also could mean Mr. Obama will have to appeal to the Supreme Court if he wants to implement his amnesty before the end of his term.

    In the 2-1 decision, Judge Jerry E. Smith and Jennifer Elrod ruled in favor of Texas, finding that the state would suffer an injury from having to deliver services to the illegal immigrants granted legal status, and ruling that it was a major enough policy that the president should have sent it through the usual rule-making process.

    Good news for now. What Pres.Obama is doing is a slap in the face to the legal immigrants who have followed the steps to become American Citizens....they show their pride. So many citizens are having enough of a problem finding jobs, without adding 5 million illegal immigrants looking for work too.

    Hooray! 1 down, umpteen million Obama travesties to go! I don't know if he is such a narcissist that he thinks he can get away with everything, or if he really thinks the public is so stupid that we won't notice (after all, they voted for him twice), but the more this man's plans are shot down, the happier I'll be! Thanks for the post. It's always nice to get good news, and any Obama failure is good news for America!

    I feel the same way as you do, Brittany, and it IS good news that he is being stopped right now. :). My worry is that the Pres will take it to the Supreme Court and he will get his way again, like he did with Obamacare. It's mind boggling that he is able to get away with all he does get away with....setting criminal illegal immigrants free, and not keeping track of them, not protecting the border...all this for more voters for his party. There are quite a few different court cases on the dockets now dealing with his orders, so not everyone is blinding themselves to what he is trying to accomplish.

    What's the answer? We have not protected the border under any administration. The border patrol can't stop illegals coming over. We are reluctant to put the military forces the border. We tried and when a marine shot someone, the public uproar stopped that endeavor. The border is not a republican or democratic issue, it's an American issue. Who do we want in this country. There has not been the political will to act firmly. What's the answer? Who can best decide among the many lining up to get into the act? How bad do we want to stop illegal crossings? What do we wish to do with the millions already here. The problem only grows worse until the pressure is great as it has been in the past and we allow another eight or ten million US citizenship. For many years we allowed it because we wanted cheap labor. Agriculture still does. What's the answer? It's a big problem. For years we've only had small politicians who've campaigned on hot buttons. No one seems to have answers to the countries' big problems that goes on year after year, having or proposing any solutions to our large problems. All we've considered and heard about is these little wars in the Middle East, someone who offers little danger to this country and this NSA security thing where we're now spying on everybody. We get all wrapped up in liberals and conservatives and forget we've got some real problems.

    Bill you are right! Every administration has dropped the ball on the immigration issue. I remember when they were just coming here in droves for the summer to work, and then when they decided to stay, and more and more came, nothing was done about it We can't just blame one administration for the problem, but some administration is going to have to fix it.

    Thanks for your post, Bill. :) You make some very good points. On some points, I have a different opinion. It seems to me, there are more problems in our immigrant numbers, since Pres. Obama took office. His adminstration is still practicing Catch and Release, and Ice is still releasing criminal aliens at a fast pace. Those that are arrested and released on bond, have no supervision. The good news is that in recent news, Obama won't take his amnesty battle directly to the Supreme Court. The European countries are getting serious about lowering their illegal immigrant population, due to problems.

    The Atlanta Journal-Constitution has published an investigative report on violent criminals released by ICE. Aptly titled "Convicted, but free to roam: Giving little notice, federal authorities have released thousands of detained undeportable immigrants — sometimes with grave results", the article tells the story of a rapist and a murderer turned loose by ICE. Such criminal alien releases are continuing at an alarming pace in 2015.

    According to documents provided to the House Judiciary Committee for a hearing last month, ICE released 30,558 convicted criminal aliens in FY 2014. These individuals had been convicted of 79,059 crimes, including 175 homicides, 373 sexual assaults, 186 kidnappings, and 14,014 impaired driving offenses (see the listing of conviction categories here).

    I'm sure it's a part of a larger plan that will be followed by any Democrat or Republican president, as a requirement for being considered electable by the media. The destruction of our country is a bipartisan effort.

    Thanks for your input, Ken. :) I have to agree that the present Republicans are ignoring the message that was sent in the 2015 midterm elections. It's pretty sad that not only do the Presidential candidates have to run against each other, they have to run against the media too, as you mentioned. Hopefully in the 2016 Presidential election, we will see Hope and Change for the better...I'm counting on it. :)
